Any submission, communication, suggestion, question, comment, photograph, video, or other content posted, submitted, or transmitted by the User to the Company or through the Website (collectively, "User Content") shall be deemed non-confidential and non-proprietary. The User expressly and unequivocally agrees, accepts, and affirms that the User bears sole, complete, exclusive, and personal responsibility for the User's own safety, health, conduct, decisions, possessions, travel arrangements, insurance coverage, and overall wellbeing throughout the User's interaction with the Website and the Services. The User shall not hold, and hereby covenants not to hold, the Released Parties responsible or liable in any manner whatsoever for any outcome, occurrence, consequence, or experience arising from the User's voluntary participation.
10.3 Nothing in this Disclaimer shall operate to exclude or limit liability for death or personal injury caused by the Company's gross negligence, for fraud or fraudulent misrepresentation, or for any liability which cannot lawfully be excluded under the law applicable to the User.
The User hereby agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, proceedings, suits, liabilities, losses, damages, judgments, awards, settlements, fines, penalties, costs, and expenses (including reasonable legal fees and disbursements on a full indemnity basis) of any kind or nature whatsoever, brought by any party and arising directly or indirectly out of, or in connection with:

No failure, delay, forbearance, or indulgence by the Company in exercising any right, power, remedy, or privilege under this Disclaimer shall operate as, or be construed to be, a waiver thereof, nor shall any single or partial exercise of any such right, power, remedy, or privilege preclude any other or further exercise thereof.
The Company reserves the absolute and unilateral right to amend, modify, supplement, revise, or replace this Disclaimer at any time, from time to time, at its sole and unfettered discretion, with or without prior notification to the User. The amended Disclaimer shall take effect immediately upon publication on the Website.
